INKA Terms of Service

These Terms of Service ("Terms") form a legal agreement between you ("you" or "your") and Votian Labs Limited, a company registered in Scotland with company number SC891614, business address 5 South Charlotte Street, Edinburgh EH2 4AN ("Votian Labs," "INKA," "we," "us," or "our").

By creating an INKA account or using any part of the Service, you agree to these Terms. If you don't agree, don't use the Service.

We've written these Terms to be as clear as possible. If anything is unclear, email us at reachout@inkaviral.com and we'll explain.

1. What INKA Is

INKA is a creator-marketing intelligence platform. It uses artificial intelligence to:

INKA outputs are suggestions and predictions, not guarantees. Real-world performance depends on many factors outside our control, including platform algorithm changes, audience behaviour, content quality, and timing.

INKA is not intended for use by individuals under 18, and we do not knowingly accept accounts from minors. If we discover an account belongs to a minor, we will terminate it.

3. Your Account

You can create an account using your email or via a supported single sign-on provider. You're responsible for:

Each person may have one INKA account. Creating multiple accounts to abuse free tier limits, manipulate the affiliate program, or evade restrictions is a breach of these Terms.

We may verify your identity if we suspect unauthorized access, fraud, or abuse. We may temporarily limit account access while we investigate.

INKA is offered in tiers. Specific features and limits may change; the current tier offering is always shown in the app.

The specific prices, limits, and feature lists are shown in the app at the time of purchase and may change. Existing subscribers will be notified before any changes affecting their current subscription.

5. Payments and Billing

5.1 How you pay

Depending on how you access INKA:

5.2 Subscriptions auto-renew

Subscriptions automatically renew at the end of each billing period (monthly or annually depending on what you chose) at the then-current price, unless you cancel before the renewal date.

5.3 How to cancel

Cancelling stops future renewals. You retain access to paid features until the end of the current billing period.

5.4 Free trials

If we offer you a free trial, you'll see the trial length, what happens when it ends, and how to cancel before being charged — all clearly shown before you start. If you don't cancel before the trial ends, the paid subscription begins automatically.

5.5 Refunds

We don't offer refunds for partially used subscription periods, except where required by applicable consumer law (for example, EU consumer law's 14-day cooling-off period for distance contracts).

If you believe you've been incorrectly charged, contact reachout@inkaviral.com and we'll investigate within 7 days.

For iOS purchases, refunds are managed by Apple — contact Apple Support. For Android purchases, contact Google Play Support.

5.6 Price changes

We may change subscription prices. If we do, you'll be notified at least 30 days before the change takes effect, and you can cancel before the change applies to you.

7. Your Content

7.1 You own your content

Posts, captions, images, diary entries, and any other content you submit to INKA remain your property. We do not claim ownership.

By submitting content to INKA, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable license to:

This license ends when you delete your content from your account, with the exception of anonymized derived patterns (which can no longer be traced back to you) and copies retained in backup systems for up to 30 days.

8. AI-Generated Outputs

INKA generates predictions, suggestions, optimised versions of your content, and other outputs using artificial intelligence.

8.1 Outputs are tools, not guarantees

AI-generated outputs are based on data analysis and may not always be accurate. Specifically:

8.2 You own your decisions

You are solely responsible for any content you publish, including content you create with help from INKA's suggestions. Votian Labs is not responsible for outcomes (good or bad) from posts you publish, including but not limited to engagement, revenue, follower growth, or any business consequence.

8.3 Accuracy

While we work to make INKA's outputs accurate and useful, we do not guarantee accuracy. AI systems can make mistakes. If you spot something that's clearly wrong, please report it via in-app feedback — that's exactly how INKA learns.

10. Intellectual Property

10.1 Our property

INKA, including all software, designs, logos, content, and intellectual property that we create, is owned by Votian Labs or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use INKA only as permitted by these Terms.

You may NOT:

If you give us feedback or suggestions about INKA, we may use that feedback freely without compensation or attribution. (We will still credit you publicly if you'd like.)

11. Third-Party Services

INKA integrates with third-party services (described in our Privacy Policy). We are not responsible for the operation, content, or policies of third parties. Your use of those third parties is governed by their own terms.

If a third-party service changes its terms in a way that affects how INKA works (for example, a social platform changes its API), we may need to modify or remove features without notice.

12. Disclaimers

To the maximum extent permitted by law:

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

16.1 Informal resolution first

Before filing any formal claim, please contact us at reachout@inkaviral.com and try to resolve the dispute informally. We commit to responding within 14 days and working in good faith to resolve issues.

16.2 Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles.

16.3 Jurisdiction

Any dispute that cannot be resolved informally will be brought exclusively in the courts of England and Wales, except where applicable consumer protection law gives you the right to bring proceedings in your local courts.

16.4 Consumer rights

If you are a consumer in the European Economic Area or United Kingdom, nothing in these Terms affects your statutory consumer rights.

We may update these Terms from time to time. When we make a material change, we will:

If any provision of these Terms is held to be unenforceable, the rest remain in full force.

18.4 Assignment

You may not assign these Terms. We may assign these Terms to any successor entity (including in a merger, acquisition, or asset sale).

18.5 Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, pandemics, war, government actions, internet outages, third-party service outages, etc.).

If you accessed INKA through Apple's App Store, you acknowledge that:
